BUILDTIME SERVICE PRIVACY POLICY

BuildTime, LLC (“BuildTime,” "we," "us," "our") is committed to protecting the privacy and security of personal data.

BuildTime makes available an employee time tracking solution that simplifies scheduling, time tracking, and compliance. The “BuildTime Service” consists of BuildTime’s online platform, which certain users within an organization can access directly in order to view and manage their employee time tracking information (“BuildTime Platform”) and BuildTime’s application for mobile devices (the “BuildTime App”) which remote users (such as supervisors) may use to scan employee workforce badges at job sites or access and manage certain information related to their employee workforce.

This Privacy Policy explains how we collect, use, disclose, and safeguard personal information with respect to the BuildTime Service. Because interaction with the BuildTime Service is significantly different from ordinary interaction of visitors with our Web site located at www.buildtime.us (the “BuildTime Website”), the Privacy Policy covering that interaction related to our BuildTime Website is separate and can found at www.buildtime.us/privacy

This Privacy Policy does not govern the BuildTime Website, other Web sites or any other data collection, disclosure or usage practices, off-line or otherwise, except as expressly noted. By accessing or using the BuildTime Service, you agree to the collection and use of information in accordance with this Privacy Policy.

BuildTime's Role

The BuildTime Service is provided to companies to assist them in managing their workforce timekeeping, and BuildTime has customer agreements with these companies that describe and limit how BuildTime uses personal data for them as part of the BuildTime Service. For most personal data processed by the BuildTime Service, the company who is BuildTime’s customer controls the purpose and means of processing the personal data (sometimes called a “controller” or “business” under data privacy laws), and BuildTime processes that personal data pursuant to its customer’s instructions (acting as what is sometimes called a “processor” or “service provider” under applicable data privacy laws). That personal data is called “Employer-controlled Data” in this Privacy Policy and is further described below. However, there are some personal data collected by BuildTime as part of providing the BuildTime Service where BuildTime acts as the controller/business and controls the purpose and means of processing. That personal data is called “BuildTime-controlled Data” and is further described below.

In general, you should look to your employer (i.e., BuildTime’s customer) with respect to requests regarding use and processing of Employer-controlled Data or exercising your rights under data privacy laws. You would look to BuildTime with respect to those requests or to exercise your rights regarding BuildTime-controlled Data only.

Notice for purposes of certain US state privacy laws

Certain jurisdictions require the controller/business to provide a summary of certain categories and purposes related to the processing of personal data. Where BuildTime is acting as a processor/service provider for the company who employs you, you should look to your employer for their privacy policies and notices, including that summary information. For BuildTime-controlled Data, i.e., where BuildTime is acting as the controller/business of personal data it processes in the BuildTime Service, the following summary applies:

The categories of personal information we collect:

  • Internet/electronic activity (such as IP address, browser, page views, and device information regarding interaction with the BuildTime Service)
  • Geolocation data
  • Inferences from the foregoing

The categories of sources of the personal information we collect:

  • You or your employer
  • Cookies and other passive data collection technologies in our BuildTime Service
  • Third party analytics and other service providers in connection with our BuildTime Service

The business or commercial purposes for which we collect personal information:

  • Providing and operating the BuildTime Service, including short-term transient uses for your interaction with the BuildTime Service
  • Security and maintenance
  • Analyzing and improving our services, systems and business and other quality control
  • Complying with law and legal process
  • Verifying your identity to respond to your requests and inquiries

The categories of personal information we share with third parties:

  • Internet/electronic activity
  • Geolocation data
  • Inferences from the foregoing

The categories of third parties with whom we share personal information:

  • Your employer (i.e., our customer): any or all of the categories of personal information above
  • Service providers: any or all of the categories of personal information above
  • Government authorities and law enforcement: any or all categories of personal information

Information We Collect

Information provided by you or your employer

You or your employer may provide any or all of the following personal data to the BuildTime Service:

  • Business contact information (such as name, email address, phone number, company name, job title)
  • Account information (such as login credentials)
  • Work-related data consisting of the following:
    • employee ID
    • work classifications, union membership/plan classification
    • time logs & attendance data (such as scan-in/out times, job site location, breaks, overtime)
    • work assignment records & job site details (such as project hours, shift schedules, and required labor reporting)
    • payroll & compliance data (such as hours worked, pay rates)
    • badge information including your photo, QR code and the information linked with it
    • employer notes and reports regarding your employment
  • Support-related data, such as support requests, tickets or other interactions with customer support for the BuildTime Service

All of the personal data described above are Employer-controlled Data.

Of the information above, the following are also BuildTime-controlled Data: any customer satisfaction data you provided as part of support interactions.

Information the BuildTime Service collects automatically

When you use the BuildTime App or BuildTime Platform, personal data are also collected through automatic means, such as cookies, web beacons and the like. The following explains the types of information we collect; these types of personal data are BuildTime-controlled Data. See also the section below titled “Cookies and other passive and automatically collected information” for more information about the types of cookies we employ.

BuildTime Platform. The BuildTime Platform collects the following:

  • Usage data, such as features that users access, pages viewed, and admin dashboard interactions
  • Device & technical data, such as IP address, browser information, GPS location of mobile devices at time of input, and session logs

BuildTime App. The BuildTime App collects the following: IP address, pages viewed, device information, browser information, GPS location of the mobile device at time of time input.

Information from third parties

If your employer connects BuildTime to its payroll provider or ERP system, then the BuildTime Platform may receive project data (such as project, phase, budget and crew structure) and personnel data (such as name, title, classification, wage, union association, project assignment) This information is Employer-controlled Data.

We may also receive personal data from our third party service providers through their services or the cookies or other technologies they use with respect to the BuildTime Service. Please see the sections titled “Cookies and other passive and automatically collected information” and “Third Parties” for additional information.

How We Use Personal Data

Employer-controlled Data

For Employer-controlled Data, you should look to your employer regarding how your personal data may be used. As it relates to the BuildTime Service, in general your employer will be using your personal data for timekeeping, payroll reporting, and labor law compliance, as well as general decisions regarding your employment, status, and compensation. Your employer— not BuildTime— is responsible for ensuring that its use of your personal data is in compliance with applicable labor, employment and other laws, including proper application of wage laws, contractor-specific labor requirements, collective bargaining agreements, and data privacy laws.

We process such Employer-controlled Data on behalf of our customers (e.g., your employer) for the following purposes: to fulfill our contractual obligations with them; to support, maintain and improve the quality of the BuildTime Service; to detect security incidents or protect against fraudulent or illegal activity; as otherwise permitted by our contracts with our customers, including their related data protection addenda; and as described in the “Other uses” section below.

BuildTime-controlled Data

We use BuildTime-controlled Data for the same purposes described above with respect to Employer-controlled Data. We may also use your personal data that is BuildTime-controlled Data for the following purposes: to contact you or send you support information, announcements and other business communications; to improve our BuildTime Service generally; and as described in the “Other uses” section below.

Other uses

In addition to the uses described above in this Privacy Policy, we may use any information, including your personal data, to the extent reasonably necessary for any one or more of the following purposes:

  • authenticating users of the BuildTime Service
  • protecting the security or integrity of the BuildTime Service and users of the BuildTime Service
  • responding to judicial process, law enforcement or for legal or regulatory compliance
  • for any use specifically permitted by applicable data privacy laws

You understand and agree that technical processing of personal data is and may be required (a) to send and receive messages regarding your use of the BuildTime Service; (b) to conform to the technical requirements of connecting networks; (c) to conform to the limitations of the BuildTime Service; and (d) to conform to other, similar technical requirements.

Cookies and other passive and automatically collected information

We may use cookies to verify your browser and maintain your session when using the BuildTime Service. We may also use cookies from third-party service providers, to analyze our BuildTime Service use and help us improve the BuildTime Service. In general, we use cookies in the following ways:

  • to provide the BuildTime Service
  • to authenticate users and protect the security and integrity of the BuildTime Service
  • to help tailor our services
  • to track communications between you and us
  • to understand, analyze, improve, maintain and administer the BuildTime Service
  • for the "Other Uses" described above

The BuildTime Platform uses the following types of cookies:

  • Strictly Necessary Cookies: These cookies are essential for the BuildTime Service's basic functioning and cannot be disabled
  • Performance Cookies: These cookies help us analyze how visitors interact with our BuildTime Service, such as which features are most popular, allowing us to improve our performance, content and design

Functional Cookies: These cookies enable the BuildTime Service to remember your In addition to strictly necessary cookies used for authentication and operation, the BuildTime Platform uses certain third-party cookies and similar technologies, specifically:

  • Intercom (Functional & Performance Cookies): Used to provide live chat support, remember user sessions, and deliver in-app messages
  • Datadog (Performance Cookies): Used to monitor system performance, detect errors, and analyze service reliability
  • Vimeo (Functional Cookies): Used to deliver embedded video content and track video playback performance

The BuildTime App uses certain third-party cookies to enhance functionality and reliability. Specifically:

  • Intercom (Functional & Performance Cookies): Used to provide in-app live chat support, remember user sessions, and deliver messages related to the BuildTime Service
  • Datadog (Performance Cookies): Used to monitor system performance, detect errors, and analyze service reliability

These services may collect device and usage data (such as device information, crash reports, and session logs) in connection with your use of the BuildTime App.

Third Parties

We use third party service providers as part of our operations and for the infrastructure of the BuildTime Service.

Third parties may use your data to operate or host the BuildTime Service or the computers that operate the BuildTime Service, store or process data for us, to help us analyze interaction on the BuildTime Service, and to provide services related to the information requests that you have submitted or communications we provide to you. Some of our key service providers include Intercom, Datadog and Vimeo.

BuildTime does not consider any transfers of your personal data to be a "sale" under applicable US privacy laws, nor does BuildTime use or disclose your personal data for purposes of cross-context behavioral/targeted advertising.

Your employer— not BuildTime— controls your personal data that is Employer-controlled Data and therefore controls with whom it shares that data. As in the case of the use of your Employer-controlled Data, you should look to your employer— not BuildTime— regarding how your Employer-controlled Data may be shared with third parties.

Data Retention

We retain your personal data as necessary for the purposes we make of it as outlined in this Privacy Policy, which means we may keep it after you or your employer stop using the BuildTime Service. At a minimum we retain Employer-controlled Data for as long as required by law and our agreement with the relevant customer (your employer).

Choice and requests

Our intent is only to use your information in compliance with applicable privacy law. In some jurisdictions, you may have legal rights regarding your personal data, including the rights to request access to, deletion of or modification of your personal data, to request a copy or transfer of your personal data, to withdraw consent to future processing, and to object or restrict certain processing.

Employer-controlled Data

If you would like to exercise your rights under applicable privacy laws regarding your Employer-controlled Data, please contact your employer directly. In general, employees may request copies of their work records, subject to employer procedures and applicable labor laws. For union-related work record requests, contact your employer or union representative.

BuildTime-controlled Data

With respect to BuildTime-controlled Data, we provide options about how the personal information that you provide us may be used, although some data may be necessary for BuildTime to provide the BuildTime Service to you. Under the laws of some US states, you have the right to opt out of processing of personal data for certain reasons (such as targeted advertising purposes), and in some US states, such as Virginia and Texas, you may have a right to appeal our refusal regarding your request for access, change, or deletion provided under those laws. Residents of some US states have the right to lodge a complaint with its designated supervisory authority. Please refer to guidance provided by your relevant supervisory authority for further information.

Some of the uses of your information are necessary for the BuildTime Service or for the reason you provided us with the information, and if you don’t want your information used in certain ways, it may prevent our ability to provide you or your employer with some or all of the BuildTime Service.

Location and transfer

BuildTime is located in the United States. Information that we collect from you may also be transferred to and stored at a destination outside the United States, or the country in which you are located. The personnel who use your information as part of the practices described in this Privacy Policy may also be located outside the United States or the country in which you are located.  By submitting your personal information, you agree to this transfer, storing and processing in the United States and as described above.

Security of Your Information

We take the security of your personal data seriously and use appropriate technical and organizational measures to protect it from unauthorized access, loss, misuse, or alteration. We maintain, or use third parties to maintain, physical, electronic, and managerial procedures designed to safeguard the information we collect through the BuildTime Service.

Children's Privacy

The BuildTime Service is not intended for use by children under 16 years of age. If we learn that we have collected personal information through the BuildTime Service from a child under 16 without the consent of the child’s parent or guardian, as required by law, we will delete it.
